SUNY Upstate Medical University: Dental, Medical, and Pharmaceutical Products

SUNY Upstate Medical University intends to purchase medical products from a contract awarded by a consortium (GPO) under section 163 (3) (vi) of NYS Finance Law, allowing for purchases without a formal competitive process when justified by price. Vendors selling equivalent or functionally equivalent products to those listed in the attached product list are invited to contact the representative to discuss procurement. Equivalency must be demonstrated by meeting the clinical performance and KPI requirements of the products. Interested parties must provide a complete cross-reference to the attached products, including pricing, unit of measure, and UOM quantities. Vendors must also provide proof of original manufacturing or certification as an authorized distributor or reseller for all proposed products. For equivalent products, vendors must furnish clinical KPIs demonstrating functional equivalency and provide products for evaluation, demonstration, and trial. This procurement is subject to NYS Finance Law §§ 139 j&k (Lobbying Law), and vendors are cautioned that the only permissible contact for this procurement is the individual listed below. Contacting any other individual may constitute a violation of New York State Finance Law, with potential consequences ranging from no contract award to debarment. The successful contractor will be required to submit applicable documents related to Vendor Responsibility, NYS Finance Law 139 j&k, and New York State's Tax Law Section 5-a.
