Cumberland County is seeking proposals from qualified attorneys or law firms to provide legal services related to mortgage-style tax foreclosures in accordance with NCGS 105-374. This Request for Proposal (RFP) aims to identify and select a secondary firm to supplement the county's primary legal services provider for these matters. Firms responding must demonstrate a thorough understanding of tax foreclosure laws, possess the capability to address owner-related issues effectively, and have proven experience with the full spectrum of tax foreclosure issues. The scope of work includes initiating and conducting foreclosures as directed by the Tax Administrator, serving notices, completing title searches, and filing complaints within specified timeframes. Firms must comply with all North Carolina laws for property tax foreclosures, provide monthly status reports, and complete foreclosure work within 12 months of starting a case. A minimum 40-year title search is required, and firms must be willing to advertise foreclosure auctions on their website and communicate electronically with the County on a near-daily basis. The contract is for new mortgage-style foreclosure accounts and requires firms to be licensed to practice law in North Carolina and be in good standing with the N.C. State Bar Association. Firms must also adhere to the County's records retention policies and meet all insurance requirements.
