Ordinance Creating a Temporary Open Container Area in Millburn Township
Millburn Township, NJ
This ordinance, number 2747-26, aims to establish a temporary "Open Container Area" within Millburn Township, New Jersey. This initiative is in response to updated state legislation allowing municipalities to designate such areas for the consumption of open containers of alcoholic beverages outdoors. The proposed area includes Block 1212 Lots 4 and 28, specifically the Millburn Courtyard and adjacent Lot 5. This designation is intended to enhance outdoor recreation and community enjoyment during a series of live music performances hosted by the Special Improvement District, Explore Millburn-Short Hills. The consumption of alcohol will be permitted on Fridays and Saturdays from 5:00 PM to 10:00 PM, and on Sundays from 1:00 PM to 6:00 PM, commencing on Friday, July 10, 2026, and concluding on Saturday, August 29, 2026. Individuals consuming alcohol must be at least 21 years old and present identification if requested, in accordance with state law. Violations of the stipulated location, times, or days will be subject to penalties as prescribed by existing law. The ordinance was introduced and passed on first reading on April 21, 2026, and will be considered for final passage at a public hearing on May 5, 2026.
